Terms of Service

Public-facing scaffold. Final terms pending counsel review; in the event of conflict, the reviewed text wins.

1 · The deal

You ("Customer") use CallFunnel.ai to place outbound or receive inbound calls. We ("Tradetron Inc") provide the platform. You pay for it. These terms cover the relationship.

2 · Compliance is on you

You are the sender for every call you place. TCPA (US), TRAI DLT (India), DPDP (India), GDPR (EU), and every other applicable regulation are your obligations to satisfy. We provide tools (per-tenant DNC, DSR endpoints, abuse monitoring) but we are not your lawyer and cannot be your compliance team.

If you call numbers you don't have lawful basis to call, you breach these terms. We will suspend your account on credible evidence of this — usually before regulators reach us, but always before they reach you through us.

3 · Prohibited use

• Calls to numbers you don't have prior consent to call (US TCPA / India DLT)
• Robocalls to TRAI NCPR / DNC-registered numbers in India
• Impersonation of any human or organization that hasn't consented
• Scams, phishing, financial fraud, fake investment opportunities
• SEBI-restricted financial advice from the bot's mouth (specific stock picks, market-timing claims)
• Calls to minors
• Voice cloning without recorded consent + KYC of the speaker (we gate this at $99 + KYC)
• Circumventing our rate limits, abuse-defense systems, or kill-switch
• Reselling without a whitelabel agreement

4 · "Am I a bot?" disclosure

You agree not to override the universal safety block that requires the bot to disclose its AI nature when explicitly asked. This is non-negotiable; we will not give you a config option to turn it off.

5 · Suspension + termination

• We may suspend immediately for: abuse, fraud, prohibited use, > 5% DNC rate, regulator request, or non-payment.
• You may terminate any time from settings. Bundled wallet balance refunds per the refund policy; subscription fees are non-refundable for the current period.
• On termination we retain your data per the privacy policy (90-day default for transcripts; longer for ledger and what law requires).

6 · Liability

Our total liability to you in any 12-month period is capped at the fees you paid us during that period. We are not liable for consequential, special, or punitive damages. We will not be liable for regulator penalties levied against you for your own calls.

Service is provided "as is" — uptime SLA is best-effort, with current state at status page. No SLA credits in v1; we'll add them with the Pro tier.

7 · Indemnity

You agree to defend, indemnify, and hold harmless Tradetron Inc against any third-party claims arising from your use of the platform — including calls you place, content you generate, and compliance failures on your end.

8 · Governing law

These terms are governed by the laws of India. Disputes resolved in the courts of Mumbai. EU + US customers retain whatever statutory rights their own jurisdiction grants them; we don't try to override those.

9 · Changes

Material changes get 14 days email notice. Continued use after that = acceptance. Don't like a change? Cancel; we'll refund prorated wallet balance.
